What is Service of Process?
According to Black’s Law Dictionary, Service of Process “is the formal delivery of a writ, summons, or other legal process or notice that must comply with the rules of civil procedure”. Once a company has been served—whether through personal service, service by mail, or a process server—, the clock starts on the time allowed for a response. A Service of Process will usually include information regarding the nature of the complaint (the reason the lawsuit was filed), the type of case, and the time the company has to respond. It may also include information regarding other documents the court requires.
Who Can Accept a Service of Process?
Some companies have a designated employee, who must be at least 18 years of age, responsible for receiving and processing Services of Process. However, since employees take lunch breaks, get sick, or go on vacation, this is not always the best way to handle legal documents.
